Terms and Conditions
1. Introduction1.1 This Agreement shall govern at all times the access and use of the Alternative Provision Service (APS) site
2. Website Operator
Alternative Provision Service (APS)site is operated by Havering Council, Mercury House, Romford, Essex, RM1 3DW. The software is designed and hosted by Arc Software Consultancy Ltd., 1 Church Terrace, Richmond, TW10 6SE
3. Licence
3.1 Alternative Provision Service (APS) grant you a non-exclusive licence to use the Site upon the following terms and conditions.
3.2 Alternative Provision Service (APS) may terminate this licence at any time without notice.
4. Materials on the site
4.1 The site may contain material which is owned by or licensed to Alternative Provision Service (APS). This material includes, but is not limited to, the design, layout, look, appearance and graphics. It is protected by intellectual property laws including, but not limited to, copyright.
4.2 You may view, use, download and store the material on the Site for personal and research use only. Commercial use is not permitted. The re-distribution, re-publication, or otherwise making available of the material on the Site to third parties is prohibited.
4.3 Unauthorised use of the Site may give rise to a claim for damages and/or be a criminal offence.
5. Accuracy of Information
5.1 The information in the Site is given in good faith and for general information and interest only. It is subject to change without notice. Alternative Provision Service (APS) is not responsible for any inaccuracies and (except as set out in clause 7.3) makes no representation and gives no warranty as to its accuracy.
5.2 The information in the Site should not be relied on and does not constitute any form of advice or recommendation. By using the Site you confirm that you have not relied on any such information. Any arrangements made between you and any third party named or referred to on the Site are entirely at your sole risk and responsibility.
5.3 Nothing on the Site is intended to be nor should be construed as an offer to enter into a contractual relationship.
6. Linking
6.1 The Site contains links to other websites. Alternative Provision Service (APS) accept no responsibility or liability for the content of other websites which are not under the strict control of Alternative Provision Service (APS). Any link is not intended to be, nor should be construed as, an endorsement of any kind by Alternative Provision Service (APS) of that other website.
7. Liability
7.1 Alternative Provision Service (APS) does not guarantee that use of the Site will be compatible with all hardware and software which may be used by visitors to the site.
7.2 Alternative Provision Service (APS) will be under no liability to you whatsoever whether in contract, tort, (including negligence), breach of statutory duty, restitution or otherwise for any injury, death, damage or direct, indirect or consequential loss (all three of which terms include, without limitation, pure economic loss, loss of profits (whether direct or indirect), loss of business, depletion of goodwill and like loss) howsoever caused arising out of or in connection with the use of the Site or the use, accessing, downloading or relying on any information or other materials contained in the Site, including, without limitation, as a result of any computer virus.
7.3 These terms and conditions do not exclude its liability (if any) to you for personal injury or death resulting from Alternative Provision Service (APS) ’s negligence, for fraud or for any matter which it would be illegal for Alternative Provision Service (APS) to exclude or to attempt to exclude its liability.
8. Monitoring
8.1 Alternative Provision Service (APS) will monitor usage of the Site, including information inputted by registered users. Alternative Provision Service (APS) reserve the right to remove any and all information which it, at its sole discretion, considers to be inappropriate.
8.2 Notwithstanding the provisions of clause 8.1 above, Alternative Provision Service (APS) are not responsible for any materials produced by registered users of the Site and shall have no liability in relation to the content of such materials, which are the sole responsibility of the relevant registered user who produced such materials.
9. Privacy
Alternative Provision Service (APS) ’s privacy policy can be obtained from the APS Commissioner.
10. Complete Agreement
These terms and conditions (including the privacy policy referred to in clause 9) contain all the terms which you and Alternative Provision Service (APS) have agreed in relation to the use of the site.
11. Jurisdiction and acceptance of these terms and conditions
11.1 The Site is controlled and operated by Alternative Provision Service (APS). The formation, existence, construction, performance, validity in all aspects whatsoever of these terms and conditions or of any term of these terms and conditions or any dispute in relation to the materials contained in the Site shall be governed by English law.
11.2 Your continued use of the Site indicates your acceptance of these terms and conditions.
